Mazoom Inc. License and Terms of Use

1. Overview
 
The following sets out terms of use for users of mazoom.mobi (“Mazoom”) a website owned and operated by Mazoom Development Group, through a limited company registered in England; MDG Incorporation Ltd. (“MDG”), Company number 2245634. Registered office; New Olives, High Street, Uckfield, East Sussex, TN22 1LD, United Kingdom. By agreeing to the following Terms of Use, you are entering into an agreement with MDG.
 
2. Acceptance of terms of use.
 
You must agree to the terms of use, to use any part of Mazoom. If you do not agree with all the terms of use, you may not use any part of Mazoom.
 
By using Mazoom, you accept and agree all provisions of these terms of use.
 
3. Who may use Mazoom.
 
Any individual or any individual on behalf of an organisation, may use Mazoom, as long as they adhere to the terms of use.
 
Mazoom can only be used by human beings, through the interface provided by Mazoom and never by any automated process, how so ever configured
 
4. Use of Mazoom.
 
Mazoom provides users access to its search functions, site information and site help, free of charge and without any membership requirement. This access is provided on the understanding that users interact with the site individually and directly, using only the interfaces provided by the site and that users do not access or attempt to access the site, in any other way, including the use of automated systems, how so ever configured.
 
Users agree to use Mazoom only as permitted by these Terms of Use and in compliance with UK laws, irrespective of the user's location.
 
Users agree not to engage in any activity that may disrupt Mazoom's services in any way, including attempting to access password-protected areas without authorisation and/or subjecting Mazoom to any form of automated, computer or cyber processes or attack; intent not withstanding. Users may not engage in any automated or systematic data collection activities, including without limitation; data mining, scraping, data harvesting and data extraction.
 
Users agree not to reproduce, duplicate, copy, distribute, sell, trade or make available in any form, either for commercial gain or otherwise, any part of Mazoom, without prior written consent from the intellectual property rights holder.
 
Users who violate these conditions accept that they may be subject to various measures, including legal proceedings and demands for damages, should they breach these terms of use. Users further accept that Mazoom can at any time block, suspend or cancel their access to the services, where the reputation or functionality of Mazoom is, or may be perceived to be, compromised.
 
5. Intellectual Property Rights
 
MDG is the exclusive intellectual property rights holder of Mazoom.  MDG fully reserves all rights in respect of its intellectual property. There are no rights, either explicit or implied, in these Terms of use, that permit the use of any MDG intellectual property, by anyone for any reason, outside the scope provided herein. Any further rights or licenses to use MDG intellectual property must be agreed in advance and in writing by the intellectual property rights holder (MDG).
 
6. Limits of Liability
 
All users of Mazoom do so entirely at their own risk.
 
Mazoom makes no guarantees, warranties or representations in respect of the services it provides to its users. The services provided by Mazoom are subject to suspension, change or removal at any time, without notice. Users access the services of Mazoom on the understanding that;
 
A. The services may be subject to interruption, disruption, delays or cancellation without notice.
 
B. The services may not meet the users expectations or requirements, including the accuracy of information accessed through those services. Users agree to access the services on the understanding that there shall be no liability on the part of Mazoom, should they experience any reduction in; site function, accuracy of data provided or access to Mazoom.
 
Mazoom provides access to third party content, for which user's will not hold it responsible. These third parties will have their own terms of use/terms and conditions, which should be consulted by users where applicable.
 
Mazoom will not be liable for any losses incurred through use of its services and/or access to third party content. Users who do not accept these limitations of liability in their entirety, must not use any part of Mazoom.
 
7. Third Party Content
 
As a Mobile Content Search Engine, providing search results to its users, Mazoom provides access to third party content, which in most instances will contain further access to additional third party content. Users access the services of Mazoom on the understanding that Mazoom cannot be held liable for any third party content provided in Mazoom search results, nor content contained in web pages, accessed through Mazoom search results. Users who do not accept these limitations of liability, in respect of third party content, must not use any part of Mazoom.
 
8. Adult Content filtering
 
Mazoom provides optional content filtering to exclude “web” listings which may contain “adult” content, as identified by Mazoom's “adult content” robotic page analysis processes. Mazoom neither guarantees nor assures its users that these robotic processes will identify and exclude all links to adult or otherwise objectionable content. Users who do not accept these limitations of liability, in respect of adult content filtering, must not use any part of Mazoom.
 
9. Privacy
 
Please view Mazoom's privacy policy, for full details.  By using Mazoom, users agree to the terms of our privacy policy, including Mazoom's use of any data collected during users use of Mazoom. Users who do not accept all provisions of our privacy policy, must not use any part of Mazoom.
 
10. Legal Provisions of Terms of Use
 
Mazoom may make changes to these Terms of Use from time to time, without advance notice. Any changes to terms of use will apply from the date of publication. Users should check this page regularly to ensure they are familiar with any changes we have made to our terms of use.
 
Mazoom may transfer, or otherwise deal with its rights and/or obligations under these terms of use without notifying its users or obtaining their consent. Users may not transfer, sub-contract or otherwise deal with their rights and/or obligations under these terms and conditions.
 
If a provision of these terms of use is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue to apply. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue to apply.
 
These terms of use are for the benefit of Mazoom and its users, and are not intended to benefit any third party or be enforceable by any third party.
 
These terms of use, together with our privacy policy, constitute the entire agreement between Mazoom and its users and supersede all previous agreements, in respect of your use of Mazoom.
 
These terms of use will be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of England and Wales. Mazoom also reserves the right to take action, where appropriate, in courts outside England and Wales.
